Recent Decisions From the Louisiana Supreme Court

IN RE DAVID H. BERNSTEIN (Metairie), 2015-B-1769, (11/16/15)
The Court denied the petition for readmission.  In denying the petition for readmission, the Court further ordered that the petitioner could not reapply for readmission until at least two years have passed from the date of the Court’s order.  In 2007, the Court disbarred the petitioner for misappropriating funds from two law firms.  In re Bernstein, 2007-1049 (La. 10/16/07); 966 So.2d 537.

IN RE RANDALL J. CASHIO (Baton Rouge), 2015-B-1710, (11/30/15)
The respondent appealed the Disciplinary Board’s imposition of a public reprimand to the Court. The Court held that the Office of Disciplinary Counsel failed to prove the formal charges by clear and convincing evidence and ordered that the formal charges be dismissed.

 

Hearing Committee Member Spotlight: Shawn Clancy Lee

With more than 30 years of experience in the legal profession, Shawn Clancy Lee knows an efficient operation when she sees one.

She has served as a public member of a hearing committee of the Louisiana Attorney Disciplinary Board for over 11 years. She has seen great improvement in the handling of complaints against attorneys, largely a result of changes implemented by the Louisiana Supreme Court.

"In the late 90's, cases moved much more slowly on the disciplinary board's docket, primarily because the respondents and their attorneys often moved to delay the proceedings. Since then, the Disciplinary Board has done a good job of setting deadlines to keep cases moving along," Lee said.

Lee became involved with the disciplinary board while working with attorney Bob Leake, who was appointed to the board in the 90’s. Leake also served as a member of the board which was busy establishing the state's rules of professional conduct. At the time, Lee was Leake's legal assistant. She became so familiar with the workings of the board, she was asked to participate as a volunteer public hearing committee member.

Today, she is the top administrator at the law firm of  Leake & Andersson and she brings a unique perspective to  hearing committee proceedings. While not an attorney herself, she has dealt with the profession for many years.  "I view cases from the attorney's perspective but also the public's. I never hesitate to speak up, ask questions and interact with the proceedings to ensure complaints are addressed appropriately."

Lee says today's technology is a huge help. "Hearing committee members can now go online and pull up the entire docket. It really moves things along and is a much more efficient process." Spoken like a true administrator. (Read Full Article)
