Wellness: A Practical Perspective

Wellness. What is it? How do you get it? How do you keep it? Is wellness the same as happy and balanced or is it simply not having ailments? Does wellness come from happiness and balance? Those are some of the questions that I asked myself when I was approached about this article.  My first thought about wellness was that the wellness hype is everywhere. Be mindful!  Meditate! Unblock your chakras! Find a work/life balance!  Employers institute “wellness” programs for employees. Prospective employees inquire as to how employers will provide them a work/life balance. It has almost become taboo to work long hours. But what if work is something that you enjoy? Is that contrary to wellness? I do not think so.



Recent Rules and Decisions

IN RE ZACHARY RYAN MOFFETT (Shreveport), 2021-B-01058 (10/19/21): The Court disbarred the respondent for neglecting his clients’ legal matters, failing to communicate with his clients, failing to cooperate with the ODC in its investigations, and engaging in the unauthorized practice of law by accepting fees and meeting with clients after his interim suspension.

IN RE CHRISTINE Y. VOELKEL (Mandeville), 2021-B-00575 (10/12/21): The Court disbarred the respondent for failing to provide competent representation to clients, neglecting legal matters, failing to communicate with clients, failing to refund unearned fees, mismanaging her client trust account, and failing to cooperate with the ODC in its investigations. The factual allegations in the formal charges were deemed admitted pursuant to Louisiana Supreme Court Rule XIX, §11(E)(3).

IN RE JEROME M. VOLK, JR. (Kenner), 2021-B-00489 (9/27/21): The Court suspended the respondent for three years for neglecting legal matters, failing to communicate with a client, failing to timely remit funds owed to a client and a third party, converting client funds, and failing to cooperate with the ODC in its investigations. The factual allegations in the formal charges were deemed admitted pursuant to Louisiana Supreme Court Rule XIX, §11(E)(3).

IN RE JOSEPH N. MAYER III (New Orleans), 2020-B-01335 (9/30/21): The Court suspended the respondent for one year and one day based upon his arrest for driving while intoxicated.

Consent Discipline:

IN RE DANTE J. BUTLER (New Orleans), 2021-B-01129 (10/1/21): The Court disbarred the respondent for engaging in the unauthorized practice of law during a period of suspension.

IN RE BRANDON WADE CREEKBAUM (Monroe), 2021-B-01296 (10/5/21): The Court suspended the respondent for one year and one day, fully deferred, based upon his arrest for driving while intoxicated.

IN RE ANDREW JAMES MURPHY (New Orleans), 2021-B-01098 (9/27/21): The Court suspended the respondent for one year and one day, fully deferred, based upon his arrest for driving while intoxicated.

IN RE JESSE P. LAGARDE (Hammond), 2021-B-00797 (9/27/21): The Court suspended the respondent for six months, fully deferred, for neglecting a legal matter, failing to communicate with his client, and failing to cooperate with ODC’s investigation of the complaint.

IN RE EUGENE P. REDMANN (Metairie), 2021-B-00955 (10/5/21): The Court publicly reprimanded the respondent for not submitting an advertisement for review by the LSBA prior to or concurrently with the publication of the advertisement.

IN RE JOHN W. REDMANN (Gretna), 2021-B-01060 (10/5/21): The Court publicly reprimanded the respondent for not submitting an advertisement for review by the LSBA prior to or concurrently with the publication of the advertisement.

IN RE SHALITA KELLY SANDERS (New Orleans), 2021-B-00776 (9/27/21): The Court publicly reprimanded the respondent for mishandling her trust account.

IN RE HARRY LANE TUTEN III (Birmingham, AL), 2021-B-01162 (10/1/21): The Court publicly reprimanded the respondent for violating Rule of Professional Conduct 1.15(a).

Reciprocal Discipline:

IN RE CYNTHIA ANN LAIN (Duluth, GA), 2021-B-00602 (10/1/21): The Court disbarred the respondent based upon the order of the Supreme Court of Georgia.

IN RE JOSEPH HAROLD TURNER, JR. (Atlanta, GA), 2021-B-00786 (10/1/21): The Court disbarred the respondent based upon the order of the Supreme Court of Georgia.

Permanent Resignation in Lieu of Discipline:
