Probation Monitor Training Seminar
On August 4, 2010, the Office of Disciplinary
Counsel will be conducting a probation monitor
training/informational seminar for any attorney interested in
serving as a probation monitor in the attorney disciplinary system.
This "no obligation" seminar is approved for two (2) hours of
Continuing Legal Education credit (1 hr. of Ethics; 1 hr. of
Professionalism), and will be held at the University of Louisiana at
Monroe.

An Emphasis on Ethics and Professionalism
The
Louisiana Supreme Court continues to address public concerns
regarding attorney misconduct. In 1990, Louisiana’s lawyer
discipline system became the first in the nation to incorporate the
American Bar Association’s Model Rules for Disciplinary Enforcement,
the hallmark of which is the use of non-lawyers in the disciplinary
process.
The purposes of lawyer discipline
proceedings are:

to protect the public
-
to protect the integrity of the legal system -
to ensure the administration of justice -
to deter further unethical conduct
-
to rehabilitate the offending lawyer
-
to deter unethical behavior by educating
other lawyers and the public.
The system is administered by a 14 member
statewide Attorney Disciplinary Board, four of whom are public
members unaffiliated with the legal profession, assisted by 117
hearing committee members, consisting of 78 attorneys and 39 lay
representatives.

Trust Account Disclosure & Overdraft Notification Authorization
This year, the Louisiana Attorney Disciplinary Board will once again offer a program to allow for electronic filing of the trust account registration and overdraft notification form. Participation in the online program is NOT mandatory. Every lawyer will have the hard copy of the form included in the registration process. For those who choose not to avail themselves of the electronic filing option, the Court approved Trust Account Registration and Overdraft Notification form will be available to you for completion. If you chose the electronic filing opportunity, DO NOT submit the hard copy form. We believe that the system created by the technology department of the Board will provide an easy and efficient means of filing your information in a timely fashion.
To participate, simply log on to our web site here. You will be taken to a page where you will be asked to register and receive your personal password randomly allotted by the system. Print out your password and store it in a secure location. Return to the site and log on. You will find on-screen instructions to walk you through the process.

La.Sup.Ct. Rule XIX, § 8(D) provides:
Any lawyer who fails to file . . . trust account
information [before July 1st], shall be mailed, by first class
mail, to the attorney's last-known primary address, a notice of
delinquency and imminent certification of ineligibility to
practice law. Any attorney who fails to comply with this notice
by August 31st shall be assessed a $25.00 delinquency penalty.
Any attorney who fails to comply with this notice by August 31st
will be summarily certified ineligible to practice law.
After August 31st, you will not be able to file
your trust account registration form online. You will have to
mail your form, along with the $25.00 delinquency penalty and
a $25.00 reinstatement fee to:
